Checking the box next to the statement on the Subscribe Page that says, "I have read and agree with the TERMS and CONDITIONS of this subscription," means that you accept the terms and conditions stipulated on this page.

1) WHAT WE DO

IntelligentValue Newsletter™ (SITE) is an online newsletter published by MoneySuccess, Inc. that provides broad educational material, training, and market information related to equity investment opportunities and specifically, our approach to investing, which utilizes both technical and classic value-oriented opinions called "Dynamic Value Investing." IntelligentValue Newsletter™ is not a financial advisory service and provides no personal financial advice.

The SITE contains analysis, information, forecasts and other opinions related to the U.S./world economy and equities markets as well as ratings, analysis, earning estimates, and proprietary stock-selection information related to specific companies whose securities are publicly traded, (collectively, the "IntelligentValue Newsletter™"). You assume the use of the opinions in the IntelligentValue Newsletter™ entirely at your own risk and it is your sole responsibility to evaluate the accuracy, completeness and usefulness of all information published in the IntelligentValue Newsletter™.

To demonstrate our investment opinions, we publish several model portfolios with different focuses, i.e., "Aggressive," "Market Trends," "Premier Value," etc. that may or may not be appropriate models for individual subscribers. These portfolio models are published for informational and demonstrative purposes only. Subscribers may use the model portfolios as ideas for their own investments or disregard them completely. Under no circumstances shall MoneySuccess, Inc., or their affiliates be liable for any direct, indirect, incidental, special, punitive or consequential damages that result in any way from your use, non-use or reliance upon the IntelligentValue Newsletter™, or that result from mistakes, omissions, interruptions or deletions of files, errors or defects in the IntelligentValue Newsletter™, delays in operation, transmission or failure of performance. IntelligentValue Newsletter™ sends out a notice via electronic e-mail when a new Market Analysis or mid-week Action Alert has been posted to the site. There are no stock picks or investment forecasts published in any of these e-mails. They simply contain a brief summary of the article posted and a link to the article. IntelligentValue Newsletter™ assumes no responsibility that the e-mails sent to subscribers as a courtesy will be sent on time or that they will be sent intact or readable. Furthermore, there are plethoras of possible problems that can occur in the transmission of an e-mail, for which IntelligentValue Newsletter™ takes no responsibility. These include problems on our end in formatting the e-mail for multiple e-mail client readers, blocks on incoming e-mail by subscriber's ISPs, network congestion, and most typically, our e-mail notices being routed to a subscriber's junk mail folder.

In order to proceed with a subscription to this SITE, subscribers agree that e-mail courtesy notices contain no portion of the informational product and accept responsibility for the proper receipt of the e-mail courtesy notices. Not receiving an e-mail is not grounds for a refund, a chargeback, or other remedies.

5) ONE USER PER SUBSCRIPTION

By subscribing, you certify that all information you provide in the registration is accurate. IntelligentValue Newsletter™ users may maintain only one active registration. In other words, it's one subscription per person. By accepting this agreement, you certify that you have no other registration with IntelligentValue™.

Further, you agree that you will not share your username/password or other access to IntelligentValue Newsletter™ with any other person unless given prior approval. You will not copy nor duplicate any content in this website to share with another person unless given prior approval. If you would like approval to use parts of our content, please contact us.

As a registered user, you can change your password at any time. To change your password, please go to the Member's Main Page and click the link in the top row on the right side menu that says, 'UPDATE MY INFO.' Also, if you forget either your password or user name, you can go to the Log-In page, insert your e-mail address and click, 'Submit.' You'll get your password info e-mailed back to you.

7) SUBSCRIPTION BILLING POLICIES

All subscriptions are rebilled automatically (recurring subscription payments) until you click the "CANCEL" link (details below) at the bottom of the Member's Main Page, and then follow the instructions on the next page. Trial Subscriptions get the first 29 days of the subscription at a discount price and if not cancelled, their credit card will be billed on the anniversary date until cancelled.

Monthly, quarterly, and annual subscriptions will be billed on a monthly, quarterly and annual basis, respectively, from the time of your signup until you ask to stop the subscription by using the automated cancellation page. There are no notices of renewal sent. All subscriptions are recurring. You may cancel at any time and your subscription will end on the next renewal date.

8) CANCELLATIONS

For your protection, all cancellations must be submitted after logging into the website's Member's Main Page

and clicking the link at the bottom of the page labeled Cancellations. Confirm your password on the next page. Your cancellation record is based on your log-in passwords. This system is designed to protect your personal information, personal portfolios recorded on the site, custom stock screeners, and your newsletter subscription from being cancelled fraudulently or in error.

In addition, requiring you to cancel your own subscription insures that there are no lost e-mails, unclear voice-mail messages, or confusion about whether you cancelled or not. Both you and IntelligentValue Newsletter™ will receive a time and date-stamped receipt of your cancellation for our records via e-mail. The receipt also provides you with the date your subscription will end.

HOW? To cancel, just log-into the site using your passwords and click the "Cancel" link at the bottom of the Member's Main Page. Follow the instructions to cancel and confirm your Username if you are sure you want to proceed. Of course, we hope you'll have another look at the high performance of our portfolio returns as well as our nearly 100% accurate market timing calls and other insightful material, compare them to the alternatives, and decide to stay.

Cancellations must be done at least one day before the renewal anniversary date, either monthly, quarterly or annually. For example, if you joined on the 22nd of one month, please don't cancel on the 22nd of another month and expect not to be charged.Cancellations on the renewal date results in being billed for another month.

9) CANCELLATION CONFIRMATION

After canceling via the Cancellations Page, the website will automatically issue you a Cancellation Receipt within a few minutes. We recommend that you keep this receipt to make sure that you are not charged again in error.

The Cancellation Receipt is date and time-stamped in order to maintain a clear paper trail for you, your bank, our processing bank, and IntelligentValue Newsletter™. The online cancellation insures that you and only you can cancel your subscription. Canceling removes any personal, portfolio or stock information you may have entered - effective on the date your subscription ends.

IMPORTANT: Should you cancel and not receive the Cancellation Confirmation, please contact us as soon as possible and we will forward you our copy of the cancellation.

10) REFUNDS

If you sign up for a Trial followed by a Monthly or Annual subscription, the initial charge ($4.95) for the 30-day trial is 100% refundable if you cancel and request a refund prior to the end of the 30-day trial. All subscribers receive an opportunity to assess the newsletter and website during the 30-day trial so you can make an informed decision on whether or not you want to continue. There are no refunds for unused subscription portions following the 30-day trial subscription.

If you cancel, you will receive a date and time-stamped receipt via e-mail and your account will not be charged again. There are no pro-rata refunds of the unused portion of your subscription .

We will do everything we can to resolve any problems that subscribers might have. If we have made a rare billing error, we will immediately issue a refund of that billing. Cancellations have been made very straightforward because we use an online cancellation form, which issues a time-and-date-stamped receipt to both of us.

Please do NOT do a chargeback of your billing. Chargeback's require a lot of time and paperwork for both of us. It's a hassle for you and a hassle for us. Unfortunately, some bad apples systematically try to take advantage of legitimate online merchants by doing a chargeback of everything they purchase. We document each transaction and will dispute a chargeback if a subscription payment is legitimate and we have delivered our services as promised. If we've made a billing mistake, we'll be glad to refund it immediately. If you have a dispute, please simply contact us and we'll mutually figure out what's an appropriate resolution.

11) TRIAL OFFER

If you sign up for the 30-day Trial Offer, you will initially be charged $4.95. If you cancel your subscription within 29 days of your sign-up, you will not be charged further. Your subscription and your access to the site will be terminated at the end of the free-trial month.

If you choose to continue your subscription after 29 days, you need do nothing. For your convenience, you will automatically be charged the monthly or annual rate after the first 30 days and for the same period thereafter until you cancel your subscription.

Monthly and Annual subscriptions receive a 14% discount of the subscription price if an initial trial month is not used. The least expensive option is a straightforward Annual Subscription. Annual subscriptions without the trial are the best value and are $54.50 less than if the trial is used.

12) YOUR OBLIGATIONS

You are obligated to self-assess your own financial situation or to consult with a Certified Financial Advisor (CFA) to help you assess your financial situation and determine if it is appropriate for you to invest in the stock market using the IntelligentValu Newsletter™ approach. You are obligated to take full responsibility for the investment decisions you make on each stock, ETF or other investment mentioned in IntelligentValue Newsletter™.

13) OWNERSHIP OF RECOMMENDED EQUITIES

MoneySuccess, Inc. and its corporate officers, or the officer's family members, may actively take positions in some or all of the stocks recommended in our portfolios.

We will never make a new purchase or sale of equities before they are recommended to our subscribers. Besides, all of the stocks we suggest have substantial liquidity and it would be virtually impossible for us to move the market with the number of subscribers we have. But we're interested in making money in the market too, and we'll buy the best stocks we can. We think the best stocks are the ones we suggest in the IntelligentValue Newsletter™, but we may be biased.

14) ADDITIONAL DISCLAIMERS

IntelligentValue Newsletter™ does not warrant the completeness, usefulness or accuracy of the content found on the Site. IntelligentValue Newsletter™ also makes no representations that our content or the service itself will be delivered to you uninterrupted, timely, secure, or error-free.

15) Entire Agreement

If any provision in this Agreement is invalid or unenforceable, the remaining provisions will continue in full force and effect. This Agreement is governed by the laws of the United States of America and the State of Illinois . You agree that the proper forum for any claim arising under this Agreement will be the U.S. Court for the Southern District of Illinois. Should a legal matter arise, you agree that it will be resolved by a mutually agreed-to arbitrator, rather than the courts.

Of course, we hope that there will never be a dispute between us. We promise to work hard and do our best to provide clear, actionable market analysis and stock suggestions that will make you money.
